Datasignify Privacy & Messaging Policy

Datasignify Inc (“Datasignify,” “we,” “our,” or “us”) respects your privacy and is committed to protecting your personal information. This Privacy & Messaging Policy explains how we collect, use, share, and protect information when you interact with us — including via our website, forms, email, phone, or text (SMS) messages.

3.1 Types of Messages

3.2 Obtaining Consent

Consent is obtained in accordance with TCPA and carrier rules through:

  • Website forms with an unchecked checkbox and clear disclosure
  • Email or in-person requests providing explicit written agreement
  • Verbal consent recorded and logged by our team

Example consent language:

"By submitting this form, you agree to receive SMS messages from Datasignify. Message & data rates may apply. Reply STOP to opt out or HELP for help. View our Privacy Policy at [link]."

We maintain timestamped records of each consent.

3.3 Opt-Out and Help

Each message includes clear instructions:

  • Reply STOP to unsubscribe and halt future messages.
  • Reply HELP for assistance or contact information.
  • Standard message and data rates may apply.

Opt-outs are honored immediately (except for a final confirmation message).

4. Data Protection and Security

Datasignify applies industry-standard technical and organizational safeguards, including:

  • Encrypted storage and data transmission
  • Access controls limited to authorized personnel
  • Continuous monitoring and auditing of systems
  • Secure retention and disposal procedures

5. Data Sharing and Disclosure

We do not share personal information except in the following cases:

  • Service providers who assist in SMS delivery or data processing (under confidentiality agreements)
  • Legal requirements or regulatory requests
  • Express consent from the individual
  • Business transfers, if Datasignify undergoes a merger or acquisition (with notice to users)

6. Industry and Regulatory Compliance

Datasignify complies with:

  • Telephone Consumer Protection Act (TCPA)
  • CTIA Messaging Principles and Best Practices
  • The Campaign Registry (TCR) requirements
  • RingCentral carrier policies for SMS registration and content guidelines

We register and maintain active campaigns with accurate sample messages and opt-in language as required. Registration approval may take up to four weeks depending on carrier review. Activities prohibited by carriers or TCR (such as SHAFT content — sex, hate, alcohol, firearms, tobacco) are strictly forbidden and will result in immediate revocation of messaging privileges.

7. User Rights

You have the right to:

  • Access your personal information
  • Correct inaccurate data
  • Withdraw consent for communications at any time
  • Request deletion of your information (subject to legal retention rules)

Requests can be made via email to privacy@datasignify.com. We will respond within a reasonable timeframe in accordance with applicable laws.

8. Retention of Records

We retain SMS consent and communication records for a minimum of four (4) years or as required by law to demonstrate compliance with regulatory bodies and carriers.

9. Changes to This Policy

Datasignify may update this policy periodically to reflect changes in law or business practices. Any updates will be posted on our website with a new effective date. Material changes will be communicated via email or text (if applicable).
